Return to Work After Leave Upon return from any medical leave of absence, Dwellworks requires an Associate to provide medical documentation stating that the Associate is able to return to work. The rights and obligations regarding the return to work after qualifying FMLA or military leave will be in accordance with applicable law. If an Associate fails to report to work upon the expiration of any type of leave, he/she will be considered as having voluntarily abandoned employment. Personal Leave An Associate may request a personal leave of absence from their position if they do not qualify for any other type of leave under this Handbook or applicable law. An Associate’s direct Leader and Human Resources must approve the leave of absence request, and the leave will be reviewed every thirty (30) days. It is important to note that an Associate’s position will not be guaranteed upon return from a personal leave of absence, as described under this Policy. Dwellworks reserves the right to fill the Associate’s position based on the needs of the business. Any Associate whose position is not available at the end of a personal leave of absence will be offered any position for which the Associate is qualified and becomes available in the three (3) month period following the end of the leave. If no position becomes available within such period, the employment relationship will terminate. The Associate’s direct Leader must approve leave under this Policy and will have the discretion to change the terms of the leave based on business needs. All personal leave will be unpaid and must be taken in full-day increments. Associates are required to apply accrued PTO their absence first before taking personal leave under this Policy. Holidays that occur while personal leave is being taken are unpaid. A Personal leave of absence, combined with any other leave under Dwellworks’ leave programs, may not exceed twelve (12) weeks in any rolling twelve (12) month period. PTO will not continue to be accrued while on personal leave described in this Policy. Continuing Education Leave Dwellworks recognizes that positions held by certain Associates require the Associate to be licensed and/or certified by a regulatory body in order to perform the duties associated with their position at Dwellworks. The maintenance of such licenses and certification may require an Associate to fulfill certain continuing education requirements that may include attending seminars and lectures. An Associate who is required to fulfill such continuing education requirements may be allowed reasonably paid absences to fulfill these obligations. Absences approved for the fulfillment of continuing education, as described in this Policy, will not be deducted from an Associate’s PTO allowance. Any such absence must be approved, in advance, in writing by the Associate’s Leader. Military and National Guard Leave Dwellworks supports those who serve in the armed forces to protect our country and complies with the Uniformed Services Employment and Reemployment Rights Act (USERRA) and all applicable state laws that provide employment protections and other rights to Associates serving in the armed forces. Dwellworks will grant an unpaid military leave of absence to Associates performing service in the armed forces, regardless of the date of hire, for a period of up to five (5) years of cumulative military service. These leaves are unpaid. Reservists, however, are entitled to a continuation of benefits under Dwellworks’ group health insurance plan at the Associate’s cost, if they are called to active duty. When possible, Associates should give at least thirty (30) days advance written notice to their Leader requesting this leave. If thirty (30) days’ notice is not possible due to military necessity, an Associate should provide as much advance notice to your Leader as possible. Associates who take leave under this Policy will not be penalized for taking such leave. Additionally, if an Associate is eligible to be reemployed, Dwellworks will restore the Associate to the job and benefits the Associate would have attained if the Associate had not been absent due to military service or a comparable job. Witnesses and Victims of Crime Dwellworks acknowledges that, on occasion, Associates may have an obligation to participate in legal proceedings either as a witness or because the Associate or a close family member was victimized by a criminal act.
